ONE LAWYER'S VIEW ABOUT DADS FIGHTING FOR CUSTODY

"The court may not prefer one potential custodian over the other on the basis of the sex or race of the custodian."

These are the words of the statute, and clearly it is the stated policy of Wisconsin not to discriminate based upon sex.

But in the opinion of this experienced divorce attorney, also a divorced dad, far too many men are fighting for custody, either out of revenge or in an effort to avoid paying child support. The role of the father in parenting is absolutely essential. Much of the problems we have in our society can be attributed to children who grew up without a strong male role model. And I am not saying that some fathers aren't the preferred parent.

But in the real world, in most families, it is the mother who is the primary parent. If you as a father, have been the primary parent, by all means, assert your custody rights. But if you have been the more typical, come home from work tired, wanting to relax, while your wife cares for the family, then you do your children, your wife and the court system a disservice by now trying to become the perfect dad.

By all means, do not accept anything but an ongoing, regular and extensive relationship with your kids. One of the positives of divorce is that sometimes dads actually become closer to their children, because they must provide all the care, during the times the children are with them. But if you have not historically been the primary caregiver, accept that you should not be so after the divorce.
